These Terms of Use (“Terms”) govern your access to and use of this website, including all live tracking maps, leaderboards, event pages, data feeds and related services (together, the “Service”) operated by Follow My Challenge S.A.R.L., a company incorporated in France (“Follow My Challenge”, “we”, “us”). By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. The Service

The Service provides live and historical GPS tracking of participants in endurance events, together with associated information such as leaderboards, checkpoints, routes and event details. The Service is provided for the personal, non-commercial use of event followers, participants and organisers.

2. Permitted use

You may:

  • View tracking maps, leaderboards and event pages through a standard web browser for personal, non-commercial purposes;
  • Share links to publicly available pages of the Service;
  • Embed maps only where we have expressly provided an embed facility or given written permission.

3. Prohibited use

Except with our prior written consent, you must not:

  • Scrape, crawl, harvest, spider or otherwise extract data from the Service by automated means, including through bots, scripts, headless browsers or any other automated technology;
  • Access the Service’s APIs, data endpoints or feeds other than through the pages and interfaces we make publicly available for ordinary browser use;
  • Copy, reproduce, republish, redistribute, sell, license or commercially exploit any tracking data, rider positions, leaderboard standings, routes or other content obtained from the Service;
  • Systematically download, store or create databases or archives of content from the Service, whether manually or by automated means;
  • Circumvent, disable or interfere with any rate limiting, access controls or other technical measures protecting the Service;
  • Use the Service in any way that imposes an unreasonable load on our infrastructure or interferes with its operation or with other users’ enjoyment of it;
  • Use any content from the Service to train, fine-tune or otherwise develop machine learning or artificial intelligence models;
  • Frame or mirror any part of the Service, or misrepresent your association with FMC UK or any event.

4. Intellectual property and database rights

The Service and all content made available through it – including tracking data, compilations of rider positions, leaderboards, route data, maps, text, graphics, logos and software – are protected by copyright, database rights and other intellectual property rights owned by or licensed to Follow My Challenge, its franchise partners and its licensors.

In particular, the collections of tracking and event data made available through the Service constitute databases in which Follow My Challenge asserts the sui generis database right provided for by Directive 96/9/EC and Articles L341-1 et seq. of the French Code de la propriété intellectuelle, together with any equivalent rights arising in other jurisdictions. The extraction or re-utilisation of the whole or a substantial part of any such database (including repeated and systematic extraction of insubstantial parts) without our written consent is prohibited and constitutes an infringement of those rights in addition to a breach of these Terms.

“Follow My Challenge” is a registered European Union trade mark (EUTM No. 015995772) of Follow My Challenge S.A.R.L. You must not use it, or any confusingly similar mark, without our written consent.

Map tiles and cartography are provided by third parties (including MapTiler and OpenStreetMap contributors) and are subject to their respective licences.

5. Event organiser and third-party content

Certain content displayed on the Service – including event routes and route files, participant names and details, event logos and branding, event descriptions, photographs and social media links – is supplied to us by event organisers, participants and other third parties. Such content is displayed under licence, solely for the purpose of presenting the relevant event on the Service, and all rights in it remain with the respective organisers, participants or other rights holders.

Nothing in these Terms, and no use of the Service, grants you any right or licence to use, copy, extract, republish or exploit organiser- or third-party-supplied content, and the prohibitions in section 3 apply to it in full. Route data in particular may be confidential or commercially sensitive to the event organiser, and its extraction or republication may infringe the organiser’s rights in addition to ours. If you wish to use any organiser- or participant-supplied content, you must obtain permission directly from the relevant rights holder.

We display this content in good faith as supplied to us. If you are a rights holder and believe content is displayed in error or without authority, contact us via https://followmychallenge.com/enquire/ and we will address it promptly.

6. Accuracy of tracking data

Tracking information is provided for entertainment and general information only. GPS positions may be delayed, inaccurate, incomplete or unavailable due to device, network, satellite or other limitations beyond our control.

You must not rely on the Service for the safety, welfare or location of any participant. The apparent absence of movement, an unexpected position, or a missing tracker does not indicate an emergency, and an apparently normal track does not indicate that a participant is safe. Safety monitoring is the responsibility of event organisers through their own procedures. If you have a genuine concern about a participant’s welfare, contact the event organiser or the emergency services — do not rely on the map.

7. Participant data

Tracking maps display the approximate location of event participants who have consented to being tracked as part of their event entry. You must not use this information to harass, follow, endanger or interfere with any participant, or for any purpose unrelated to following the event. Details of how we process personal data are set out in our Privacy Policy [LINK].

8. Availability

We aim to keep the Service available during events but do not guarantee uninterrupted or error-free operation. We may suspend, withdraw, restrict or modify all or any part of the Service without notice, including blocking access from IP addresses, user agents or networks that we reasonably believe are breaching these Terms.

9. Liability

Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, for fraud or gross negligence, or for any other liability that cannot lawfully be excluded or limited.

Subject to the above, the Service is provided “as is” and we exclude all implied conditions, warranties and representations. We shall not be liable for any loss or damage, whether in contract, tort (including negligence), breach of statutory duty or otherwise, arising from your use of or inability to use the Service, or from your reliance on any content displayed on it. The Service is provided free of charge for personal use, and we accept no liability for business losses of any kind.

10. Breach and enforcement

If you breach these Terms we may, without prejudice to our other rights and remedies, immediately suspend or block your access to the Service, and we reserve the right to take legal action, including claims for infringement of intellectual property and database rights and for damages reflecting the cost of unauthorised use of our infrastructure and data.

11. Changes to these Terms

We may revise these Terms at any time by updating this page. The revised Terms apply from the date of publication. Please check this page periodically.

12. General

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full force. These Terms constitute the entire agreement between you and us regarding use of the Service. No failure by us to enforce any provision constitutes a waiver of it.

13. Governing law and jurisdiction

These Terms, their subject matter and formation are governed by French law, and the courts of Périgueux, France shall have jurisdiction over any dispute arising from them. If you are a consumer, this choice of law and forum does not deprive you of the protection of mandatory provisions of the law of your country of habitual residence, or of your right to bring or defend proceedings there.
